Can the President Block You on Twitter? [POLICYbrief]

With President Trump, there's a tweet for everything.,For the last seven or eight years, he has been tweeting on every conceivable issue that,confronts us.,This was not much of an issue before he was a politician.,As a private citizen, he could say whatever he wants on Twitter and he can block whomever,he wants, and it really creates no problems.,However, if official capacity Trump, the president of the United States on a government account,,blocks people, that does implicate the First Amendment and that's the basis of the lawsuit,being litigated now in New York.,The seven plaintiffs in the litigation claim that they were blocked by President Trump,on Twitter.,These are everyday people.,They're lawyers, activists, thinkers, writers.,They come from different walks of life and they all share one thing in common: They said,something that President Trump didn't like and President Trump retaliated by blocking,them on Twitter.,These people filed a lawsuit in federal court in Manhattan and they argued that the president,was violating their First Amendment rights by blocking them on Twitter.,Our First Amendment case law teaches the government can't pick winners and losers.,They can't say, "A-ha!,Speech we agree with, we'll let you in.,But speech we disagree with, you guys have to be quiet.",We have to let everyone speak and only the best ideas will prevail.,That's the basis of how our free speech system operates.,A public forum is a place where the government allows people to generally speak.,The classic example is a sidewalk.,If I want to walk down a sidewalk and I want to hand out pamphlets complaining about some,government policy, or I want to walk down the sidewalk and hold up a sign saying stop,this or stop that, I don't need a permit.,I don't need to ask the government's permission, and the government can't tell me not to do it.,So, sidewalk's easy.,The big question that's considered here is, what kind of forum is Twitter?,The federal district court in Manhattan ruled against President Trump and the court of New,York held that this was something of a public forum.,The court reasoned that President Trump used his Twitter account as a conduit of government,information, used it to announce government business, his staffer had access to it.,It wasn't just a private account, it was an official account, and once you have this sort,of public forum, the president can't exclude people on the basis of their viewpoint.,I think the best arguments in favor of the plaintiff is that they were blocked from this,public forum, uh, because of their viewpoints, and that constitutes viewpoint discrimination.,Trump's best argument is that district courts can't tell the president how to do their job,,that it's up to the president to decide how best to manage his administration, and that,district courts should not be micromanaging these things about how he manages his Twitter account.,I think the ruling has fairly widespread implications.,All government actors -not just politicians- but mayors, sheriffs, universities, public,state universities, uh, will now have to keep their social media policies open.,This is the first time a president has been sued for his use of social media in any capacity,whatsoever.,This is fairly novel ground we're breaking.

what did the federal,appeals court say so in a nutshell what,the court said is President Trump,because he's using his Twitter account,publicly can't ban critics so someone,has a different point of view than the,president,he can't block them from his Twitter,handle because that violates the First,Amendment right and so how does this,will this go across the board now for,for others in Congress or is it just,like on a one-person basis right now for,the president so the court was really,careful to say this applies to the,president's Twitter account what they,did is they analyzed his account there,were arguments made by the president's,legal team that he was using his account,as a private citizen and the court,rejected that and said no in this case,with respect to the president he's,clearly using his Twitter account as a,public forum where there is an exchange,of ideas people are responding by,Twitter and that's generating thousands,if not hundreds of thousands of,responses he has over 60 million Twitter,followers so this is a public forum,according to the court and so it applies,to the president in this case with,respect to other public officials I,think it's gonna come down to how are,they using social media are they using,it publicly are they using it privately,is it just a private Facebook account,that has nothing to do with their,political office and I think that will,affect what the outcome is and the court,said as much now walk want this get if,they're going to do it on a,person-by-person basis can't this get,taxing as far as a lot of a lot of work,as far as going basis by basis so just,by saying it's on a case by case basis,doesn't mean you have to go through,every case so the court is setting down,some general principles so one of the,general principles that the Second,Circuit Court of Appeals set forth is,that the,an account is being used as a public,forum then it is subject to the First,Amendment so I would say that according,to the second Second Circuit Court of,Appeals at least that if you have,another public official who was using,their social media for entirely public,purposes then it is going to be subject,to the First Amendment free of free,speech protections okay and then for the,president he also has that official,POTUS account but that never really gets,the big news because he uses that real,Donald Trump as the one to really make,is a big basis and big claims so if he,was just going to do like hey I'm having,a great day,then if he didn't put no policy out,there that would have been fine then he,could start blocking people or so I,think if he has a private Facebook,account that he shares with just friends,and family members and and it really is,I went on vacation these are how my this,how my grandchildren are doing something,of that nature that purely was private I,think then you can blog people but but,again we'd have to see what the court,says the court went made very clear that,with a public official with respect to,public officials and their private,accounts we're not ruling on that so to,me I would think the more we get into,the world of private use I think then,the First Amendment protections are less,strong that's my opinion but we'd have,to see what the courts do and for the,courts now though also looking at AOC,the Democrat that's getting always a lot,of publicity as well right so it,shouldn't be this is not a Democrat,Republican issue this is not the,president but it doesn't apply to a,senator or to our mayor I think this is,about public officials and using social,media for public purposes to have an,exchange of ideas to have a public forum,and then I think what the court is,saying is it applies to you if you're,that person so it's not specific to the,president it's not specific to the,office it's not specific to the party,mm-hmm sure now what about this one if,there is somebody that is tweeting them,harassing them can he just block that,person and say you know I don't want to,see that or do you just put them on mute,so I think there are differences and so,we're talking right now in this case,about people who are,critical of the president from a policy,standard so in that area clearly that's,subject to the First Amendment if you,have someone who is is expressing,violent conduct or foul conduct on a,social media account then I question is,that really free speech is that subject,to the First Amendment protections I,think that's a different situation than,we're dealing with here,there was never an argument at least to,my understanding the U.S intelligence,committee as a foreign State actor,committing cyber operations will be,removed so there's they're essentially,saying that privately if the if the,intelligence Community fingers an,account and says we want to get rid of,that we're going to do it and that,basically committed them to this endless,cycle of moderation requests,all right so one of them is new a new,case of U.S intelligence officials,trying to censor reporting on anything,critical of the Biden family and their,dealings inside of Ukraine we know from,before this is the well-publicized case,where before the 2020 election the uh,social media giants like Twitter,censored reporting on the hunter Biden,laptop which contained information about,his business dealings on the fake,grounds that it could be Russian,disinformation right so you have a new,uh case here where you say the U.S,intelligence officials,um warn Twitter about publicity,surrounding a book by former Ukraine,prosecutor Victor shulkin who alleged,corruption by the U.S government,specifically by Joe Biden now shokin,as a reminder to people he was the,prosecutor who was investigating barisma,in Ukraine and who was barisma barisma,is the company that shortly after the,2014 U.S Baku which Joe Biden's,government was involved in in Ukraine,brisma hired Hunter Biden uh to their,board making something like eighty,thousand dollars a month and what,choking allege was that basically,barisma hired but uh Biden to help,shield barisma from his own offices,scrutiny and he wrote a book about it,and here is Twitter getting a warning,about that book about how it really,could be some sort of Russian,intelligence operation so let's read,from some of what Twitter was told this,is a U.S intelligence assessment that,was shared with Twitter we assessed with,high confidence that in the summer of,2020 members of a Russian influence,organization which is at least partially,directed by Russian intelligence we're,aware of a production plan associated,with an upcoming book authored by former,Ukrainian prosecutor General Victor,shoken so this is very this is tough to,follow aware so some influence,organization which they don't Define,which is partially connected to Russian,intelligence they're aware of a book,that's about to come out wow big,bombshell but apparently that's the,that's on in their eyes grounds for,censorship so let's go on with this,um we have information that indicates,that the book is intended to reveal,corruption allegedly perpetrated by the,U.S and Ukraine and that the intended,audience includes political institutions,in the U.S Europe and Ukraine versions,of the book could be released in Russian,Ukrainian and English this fall so wow a,book is going to come out and it might,reveal corruption by U.S figures namely,Joe Biden and his family in Ukraine,yeah and and,that's your guidance right so to be,perfectly fair about this like I I was,not able to determine which government,agency this came from I I could tell,that it came through the FBI,um but there were a lot of these,documents that are sort of marked oga or,weren't marked at all and simply came,through uh you know the belly button,through either through teleporter or,through signal to Twitter this was,actually retrieved from the laptop of,one of the senior Executives who left,um but,unquestionably there were so many,um of these reports where they would say,something extremely vague like we have,indications that this is connected to,the in to the you know the IRA the,internet research agency and then they,would send a list of accounts and you,were just supposed to to say well they,assessed it so we might it must be true,um and I guess in this case they didn't,even send a list but it was for their,information like if you if you want to,take action against any tweets that,might have to do with shokun's book,um you know we're sort of encouraging,you to do so which I I think is You guys here on Twitter right.,To activism, Twitter has become a staple of our modern society.,I don't think that there's ever been a tool before in the history of,mankind where you can just so easily share what you got to say with so,many people so quickly.,I just wanted to see everything that was happening, not just where people,were, but what what they were doing, you know?,And I wanted to be able to see the world in real time.,But it's sheer volume of content disseminated in more than 40 languages.,Twitter has become an online running theme for recording our global,history. But a social platform success has not come without questions,around the company's profitability and growth and controversy around its,role in deciding what content should and should not be broadcast to its,166 million daily active users.,In 2006, Twitter was born out of the ashes of another San Francisco startup,called Odeo. The company was trying to do like Internet radio, but it,wasn't really panning out and they were running out of money.,But in 2005, it became clear that Odeo couldn't compete with Apple's,iTunes. So that's when they turned to all the employees.,And they said that if you have an idea.,Now is the time to try it.,And at the time, one of the engineers, Jack Dorsey, he spoke up about his,idea to essentially let users send out a broad text message to folks,through this thing called Twitter.,Twitter's 140 character limit was originally inspired by the length limit,of SMS messages.,This would later be expanded to 280 characters.,By March 2006, Dorsey had created a working prototype of the platform and,sent his first tweet out into the world.,Where the company really started to gain a foothold with the mainstream was,in 2007 at the South by Southwest event in Austin.,During the event, Twitter tripled its traffic from 20000 to 60000 tweets,per day. That same year, Dorsey was officially voted in as Twitter's CEO,,a title which he didn't hold onto for very long.,He was very young, very green, and he wasn't particularly polished as CEO.,This led to his ouster in 2008.,Twitter co-founder Evan Williams took the reins of the company after,Dorsey's departure. He could do rallies as soon as he became president, a lot of,those avenues of communicating directly to the public were closed off to,Trump. certainly the the DHS,somebody from the DHS letting I think,was The Times know that they actually,had tried to correct Miller and Bannon,on the green card exemption that's right,and they were overruled overnight that,sort of thing certainly did send a,message back but this is Donald Trump,acts like this is the first time this,has been happening the White House under,Bush was horrified I'm you know Obama,obviously more aggressively went after,leakers than anybody but even under Bush,a lot of the bad news Bush received,early on with the Iraq war came from,inside his own CIA that's right and you,know there can be a destructive nature,to leaks there can also be an extremely,constructive nature to leaks because,frequently it's a way for people to make,sure that an issue gets aired and just,because it's a leak does not necessarily,mean that it's necessarily damaging and,I would argue that in the case of the,executive orders Mullen some of these,leaks actually helped the Trump,administration get it,back together earlier in this first,month he seems so focused on leaks from,the Intelligence Agency when we know,that there's a lot of leaks that come,from his own administration people that,have been in a room with them sometimes,we learned that phone calls were five,people we see the photo have been in the,room and yet we know details that only,one of those five people would know so,we see this on a repeated basis here,journalists getting calls from somebody,within the administration I said that,Priebus and Bannon and Kushner didn't,leak about each other,but there's a lot of leaking going on,about other things other people from,everybody in some details of phone calls,with heads of state yeah only a few,people wouldn't be privy facial,expressions during those phone calls,right no it's not just what we see in,the photo it's what's actually happening,inside the room David you've covered a,lot of these administrations you've seen,roll out some better than others how,unusual how strange how different is,this really from the Trump,administration from Barack Obama george,w bush going back you know willie i,think it could settle into something,more normal the first month has not been,normal usually what happens in,administration is they're fairly leak,free for the first couple of years,because the people who come in around,the president are convinced that that,president is the best thing ever that,came through the campaign and then,there's they they make their way out and,there's a rescue team that comes in to,go fix things and they immediately say,well we're gonna make this better you,can't believe what the what the last,last folks did this time this has all,happened in the first month or so and i,think in part it's the fact that you've,got a an administration here full of,people who have never been in government,before I just don't know these levers,just doesn't this remind you a good bit,obviously Donald Trump is everything is,super-sized,but doesn't remind you a lot of the,first few months of the Clinton,administration that just had one they,started with the gays in the military,and everybody that's a World War three I,think two of their justice picks were,immediately disqualified,they had travelgate early on they had,Stephanopoulos going to the FBI saying,write this press release something,we forget the first six months and that,was so chaotic I guess until Gorgon and,Panetta came in,that's right Gorgon came in and said it,reminded him of the set of home alone,and there's a little bit of home alone,ish going on now we come to some of the,agencies you know during the State,Department these days you know there's,the secretary sitting up there and he,doesn't have a deputy
